Adjudication Processes

Upon completion of a formal complaint investigation under Policies 1340 or 1346, the Title IX Office transfers the investigative report, all evidence collected and submitted, and all responses submitted to the university entity responsible for coordinating the adjudication process to determine the outcome.

The adjudication process that is used to reach an outcome in a formal complaint of sexual misconduct or Title IX sexual harassment depends on whether the allegation(s) that is(are) the focus of the complaint fall under Policy 1340 or Policy 1346 and whether the respondent is a student, employee, or affiliate.

When the allegations that are the focus of the formal complaint fall under Policy 1340 and Policy 1346, Policy 1346 will govern. Refer to Policy 1340 Section 6.9(h) for more information.

If the respondent is a student and...

… the allegations that are the focus of the complaint fall under Policy 1340, then the Sexual Misconduct Accountability Process administered by OSARP will be used.

… the allegations that are the focus of the complaint fall under Policy 1346, then the Title IX  Sexual Harassment Adjudication Process administered by OSARP will be used.

If the respondent is...

… involved in the adjudication process for alleged violations of Policy 1346 (Title IX Sexual Harassment) or Policy 1340 (Sexual Misconduct) and is a university employee in Academic Affairs, except wage or classified employees and affiliates, then Academic Affairs will use the process detailed here.

… involved in the adjudication process for alleged violations of Policy 1346 (Title IX Sexual Harassment) or Policy 1340 (Sexual Misconduct) and is a university employee or affiliate, then Human Resources will use the process detailed here.
