Confidentiality

The information shared during the mediation or restorative justice process is confidential. The only exception to confidentiality is information that is determined to be a threat to self or others. It is important to note that information revealed in mediation or restorative justice cannot be used as evidence in any judicial process unless that information can also be discovered outside of the restorative justice or mediation forums.

Judicial Implications

Mediation and restorative justice is often used as an alternative to bringing judicial charges against another student. The right to press charges against another student remains in the event that no agreement is made or one or both parties do not follow the agreement.
