The Interview Process
You are encouraged to follow JMU hiring guidelines, including use
of the suggested interview questions found on JMU's Human Resources
web site at:
http://www.jmu.edu/humanresources/employment/managertools.shtml
In relation to immigration discrimination and hiring regulations,
it is most prudent to follow these guidelines:
- Do NOT ask a person about his/her citizenship or immigration
status at any point prior to the final offer of employment;
- You may ask only if the person is "currently eligible for
U.S. employment" - however, remember that if you ask that question
of one person, you MUST ask it of everyone;
- If the candidate indicates that s/he is not "currently eligible
for U.S. employment," it is permissible to ask whether s/he
will require JMU sponsorship.
If a candidate asks whether JMU sponsors employees for an employment
visa, the answer is yes, provided the job is one which fits the
legal criteria for sponsorship (generally a professional position
which requires a specific degree - see information about H-1B visas.)
You and/or the candidate are encouraged to contact oIP's' Director
of International Student and Scholar Services for additional information
about our general practices related to employment sponsorship.
